Flemingsburg City Council held their regular monthly meeting Monday, September 11, 2206 at 7:00 p.m. in the City Annex.  Council members present were Marty Voiers, Carl Haight, Nancy Suit, Georgianna Sparks, Meredith Story, and Scott Manning.  Mayor Louie K. Flanery presided.

 

 Councilman Story led the Pledge of Allegiance.  Minutes of the previous meeting were presented.  Councilman Haight moved to approve.  Councilman Manning seconded the motion.  All were in favor.

 

David Graham addressed Council regarding his water problems.  Graham presented a water filter after one month of usage and asked if a section of line had been taken out for inspection.  He stated that the filter was white to begin with, but was now brownish gray.  Mayor Flanery stated that it had been discussed and determined that it would be a lot of cost and prove nothing.  Councilwoman Sparks asked if Graham’s filter could be shown to the state.  Mayor Flanery stated that the Division of Water said the water was improving.  The City has to listen to them and do what they say.  Graham stated he would continue to come back every month until his water improves. 

 

Councilman Story said his water is hard and it looks like the lines are dirty.  Councilman Voiers, who is on the same line as Graham, said he did not have filters to compare but hadn’t noticed his water being dirty.  Voiers asked if water could be taken from the Graham house and tested to see if the water is good.  Graham said the filter he presented had a month’s worth of crud in it. Councilwoman Suit asked if Graham used a filter system before the water changed to GFCRWC.  Graham stated that he didn’t because he didn’t need it.  Utilities Superintendent Kenny Dearing stated he had one customer in Indian Fields who was using a filter system, but their water was not dirty.  They had only complained of odor.  Councilman Voiers suggested testing the water on both sides of the filter.  Dearing stated he would check the water and then check the meter.  It could be old, creating dirty water.  Dale Clary commented that the house used to get water from a cistern, but Scotty Perkins changed to City water in the 1980’s.  There was a ¾” plastic line from the water tower on Mills Ave. to the house.  Councilman Story suggested checking with Morehead to see if their facilities could do more tests than Pikeville. Mayor Flanery instructed Dearing to check the meter first thing in the morning.  Councilman Voiers asked his to check his water as well to see if there was any difference.

 

City Clerk Joy Roark presented the second reading of Ordinance No. 9-06-1 regarding the motor vehicle tax rate.  Councilman Haight moved to approve.  Councilwoman Suit seconded the motion.  A roll call was given with all voting in favor.

 

City Clerk Joy Roark presented the second reading of Ordinance No. 9-06-2 regarding the property tax rate.  Councilman Story moved to approve.  Councilman Manning seconded the motion.  A roll call was given with all voting in favor.

 

City Clerk Joy Roark presented the second reading of Ordinance No. 9-06-3 regarding the International Property Maintenance Code.  Councilman Voiers moved to approve.  Councilwoman Sparks seconded the motion.  A roll call was given with all voting in favor.

 

City Attorney Tom MacDonald presented a draft of an Adult Entertainment Ordinance for review by the safety committee to make recommendations and bring back to Council.  A meeting was scheduled for Tuesday, September 12th at 5:00 in City Hall.

 

Mayor Flanery recommended David Doyle be appointed to the Planning Commission.  Councilman Manning moved to approve.  Councilwoman Suit seconded the motion.  All were in favor.

 

Mayor Flanery presented three resolutions for KIA funding, Industrial Park II $100,000, Water Line Improvements in the Downtown area $50,000, and the Cherry Grove Road Sewer Project.  BTADD will provide the administrative services.  Grant funds are 100%.  Engineers are flagging lines on the properties to be annexed.  Property owners are aware where lines are expected to run.  Mayor Flanery noted it is the standard state procedure for grants.  Paperwork would be available in his office for review.  Councilman Voiers moved to authorize the mayor to sign documents pertaining to the Cherry Grove Road Sewer Project to receive grant funds from KIA.  Councilman Haight seconded the motion.  All were in favor.

 

Councilman Story moved to authorize the mayor to sign documents pertaining to the Water Line Improvements in the Downtown Area to receive $50,000 in grant funds from KIA.  Councilman Manning seconded the motion.  All were in favor.

 

Councilwoman Sparks moved to authorize the mayor to sign documents pertaining to Industrial Park II to receive $100,000 in grant funds from KIA.  Councilwoman Suit seconded the motion.  All were in favor.

 

Councilman Story reported that he and City Attorney Tom MacDonald were still working on the utility ordinances trying to create all new ordinances and a unified billing ordinance.

 

Mary Jo Litton presented the EDC report.  Litton stated that work was being done on the second floor of the Museum and they hoped to open on Founders Day.

 

Gene Schwartz reported on the ISO meeting.  Schwartz stated that the community was evaluated and the fire rating should stay the same.  Councilman Voiers asked Schwartz to check into parking on sidewalks to see if it was prohibited.  Councilwoman Suit complained of large trucks with double cabs parking on the courthouse hill.  Mayor Flanery stated Jim Compton was checking with the state about slanting the parking spaces more.  Making the street one-way has also been considered.

 

Jim Compton reported that the City would have $45,000 in discretionary funds to do blacktopping and bridgework. 

 

Mayor Flanery stated that the City would receive $32,018 from the Land, Water Conservation Fund.  The City applied for $72,000.  It would be a 50-50 match.

 

Police Chief Danny Carpenter reported that the Police Department had been audited and everything was in good shape and in compliance.

 

Councilman Voiers reported a complaint of animals running loose around the stockyards.  The Police Department was called, but no one responded.  Chief Carpenter will check into this matter.

 

Councilman Manning reported streetlight problems on Crest Ave.

 

Councilman Story reported a leaky fire hydrant at the sewer plant.  Dale Clary stated that the hydrant was an old one that originally came from Bill Graham’s farm.  It has leaked for fifteen years and will have to be dug out and replaced.  Cost for a new hydrant is $1100.

 

Councilman Voiers requested that the City advertise for people interested in serving on boards.  Voiers questioned if CDBG funds could be used for repairs or replacement of sidewalks.  Other cities have similar programs.

 

Mayor Flanery reported that he was waiting for Vanceburg’s mayor to get an approved price and permission to negotiate from his City Council before proceeding with the purchase of the recycling containers.  The City may need storage space for the containers.

 

Councilman Haight questioned the status of the sewer line break at the new development on the by-pass.  Cost for repairs were $2,500-3,000.  Dale Clary said the contractor would try to reimburse the City through the contract on the Library.

 

City Council set the date for Trick or Treat as October 31st from 5:00 – 7:00 p.m.

 

Mayor Flanery set a special meeting for Monday, September 18th at 5:30 p.m.

 

There being no further business Councilman Manning moved to adjourn at 8:27 p.m.  Councilman Haight seconded the motion.  All were in favor.
